1. Introduction

Welcome to The Mind Distillery Ltd ("The Mind Distillery," "we," "us," "our"). We are registered in England and Wales under company number 12923665, with our registered office at 45 Old School Square, London, UK E14 7DJ.


These Terms and Conditions ("Terms") govern your access to and use of:


  • Our public marketing website located at https://aminds.ai and any related subdomains, content, resources, and materials provided thereon (collectively, the "Site").

  • Our A·Minds software-as-a-service platform, accessed via login credentials (the "Platform"), but only concerning your individual conduct and responsibilities as an authorised user.

By accessing or using the Site, or by accessing or using the Platform as an authorised user, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site or Platform.

2. Scope and Relationship to Customer Agreements

  • Website Visitors: These Terms apply to all visitors accessing the Site.

  • Authorised Platform Users: These Terms apply to individuals who are employees or authorised agents ("Authorised Users") of a company or entity (our "Customer") that has entered into a separate Master Service Agreement ("MSA") and Data Processing Agreement ("DPA") with The Mind Distillery for the use of the Platform.

IMPORTANT: For Customers and their Authorised Users, the MSA and DPA govern the commercial relationship, subscription terms, payment obligations, service levels, data processing specifics, confidentiality obligations, warranties, and overall liability related to the provision and use of the A·Minds Platform service. In the event of any conflict between these Terms and the MSA or DPA regarding those specific subjects, the terms of the MSA and DPA shall prevail. These Terms primarily govern the acceptable use of the Site and the individual conduct and responsibilities of Authorised Users on the Platform, complementing the MSA.

3. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data in connection with your access to and use of the Site and Platform are described in our Privacy Policy and our use of cookies is described in our Cookie Policy.

4. Intellectual Property Rights

The Site and the Platform, including all underlying software, technology, text, graphics, logos, icons, images, audio clips, video clips, data compilations, and the arrangement thereof, as well as any content made available on the Site (such as blog posts, research, analysis, and resources) are the property of The Mind Distillery or our licensors and are protected by United Kingdom and international intellectual property laws.


We grant you (as a Site visitor or Authorised User) a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and/or Platform solely for its intended purpose and in accordance with these Terms (and the applicable MSA for Authorised Users).


You may view, download for caching purposes only, and print pages or other content from the Site for your own personal or internal business use, subject to the restrictions set out below and elsewhere in these Terms. You may share or circulate content explicitly designated as shareable (e.g., blog posts, research articles) provided that A·Minds (aminds.ai) is clearly attributed as the source and you include a direct link back to the original content URL on our Site (https://aminds.ai).


All rights not expressly granted to you in these Terms are reserved by The Mind Distillery. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.

5. Permitted Use and Prohibited Activities

(a) Website Visitors:

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited behaviour includes, but is not limited to:


  • Using the Site for any unlawful purpose or in violation of any applicable laws.

  • Reproducing, duplicating, copying, selling, reselling, or otherwise exploiting any material on the Site for commercial purposes without our express written permission.

  • Conducting any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction, and data harvesting) on or in relation to the Site without our express written consent.

  • Using the Site in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site.

  • Introducing any viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.

  • Attempting to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.

  • Misrepresenting your affiliation with The Mind Distillery or A·Minds, or suggesting endorsement where none exists.

  • Removing or obscuring any copyright, trademark, or other proprietary notices contained on the Site.

(b) Authorised Users (Platform Acceptable Use Policy - AUP):

In addition to the general prohibitions above (where applicable), as an Authorised User of the Platform, you agree not to:


  • Share your login credentials (username, password, or access granted via OAuth providers like Google/LinkedIn) with any other person or allow any third party to access the Platform using your credentials.

  • Attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform, or to any of the services offered on or through the Platform, by hacking, password "mining," or any other illegitimate means.

  • Probe, scan, or test the vulnerability of the Platform or any network connected to the Platform, nor breach the security or authentication measures on the Platform or any network connected to the Platform, except as may be expressly permitted under the terms of the MSA (e.g., pre-approved penetration testing).

  • Reverse look-up, trace, or seek to trace any information on any other user of or visitor to the Platform, or any other customer of The Mind Distillery, including any account not owned by you, to its source, or exploit the Platform or any service or information made available or offered by or through the Platform, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Platform.

  • Interfere with or disrupt the operation of the Platform or the servers or networks used to make the Platform available, including by transmitting any worms, viruses, spyware, malware, or any other code of a destructive or disruptive nature.

  • Use the Platform or any outputs generated by the Platform for any illegal purpose, or in violation of any local, state, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, data protection and privacy, and applicable employment and anti-discrimination laws. You are solely responsible for ensuring your use of the Platform and its outputs complies with all applicable legal and ethical standards.

  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of the Platform or any software, documentation, or data related to the Platform.

  • Use the Platform to store or transmit infringing, libellous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third-party privacy rights.

Violation of these AUP provisions may result in the suspension or termination of your individual access to the Platform, without prejudice to any other rights or remedies The Mind Distillery or the Customer may have under the MSA.

6. User Accounts (Authorised Users)

Access to the Platform requires Authorised Users to log in using credentials managed via our third-party authentication provider, which may include direct login or OAuth through services like Google or LinkedIn.


You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to immediately notify The Mind Distillery at support@aminds.ai (or as otherwise directed in the MSA) and your designated Customer administrator of any unauthorized use, or suspected unauthorized use, of your account or any other breach of security. The Mind Distillery cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

7. Disclaimers

  • Site Content: The information and materials on the Site (including blog posts, resources, pricing information, and product descriptions) are provided for general information purposes only. While we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the Site or the information, products, services, or related graphics contained on the Site for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

  • Platform Availability: Access to and availability of the Platform for Authorised Users are governed by the terms of the applicable MSA, including any service level commitments therein.

  • General: To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

8. Limitation of Liability

Please read this section carefully as it limits the liability of The Mind Distillery.


  • Relationship to MSA: For Customers and their Authorised Users, the limitations and exclusions of liability regarding the provision, performance, or non-performance of the Platform service itself are governed exclusively by the MSA.

  • Use of Site & Breach of These Terms: To the maximum extent permitted by applicable law, The Mind Distillery (including its directors, employees, agents, or affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

    1. your access to or use of or inability to access or use the Site;
    2. any conduct or content of any third party on the Site;
    3. any content obtained from the Site;
    4. unauthorised access, use, or alteration of your transmissions or content (except as governed by the DPA); or
    5. your breach of these Terms.

  • Cap on Liability (Site Use/Term Breach): To the maximum extent permitted by law, in no event shall the aggregate liability of The Mind Distillery for all claims relating to the use of the Site or arising from a breach of these specific Terms (distinct from liability under the MSA) exceed one hundred pounds sterling (£100).

  • Exclusions: Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Mind Distillery, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third-party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Site or Platform, your violation of these Terms, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. This indemnification obligation is separate from and in addition to any indemnification obligations set forth in the MSA.

10. Third-Party Links

The Site may contain links to third-party websites or resources. You acknowledge and agree that The Mind Distillery is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by The Mind Distillery. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

11. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect, such as by posting the updated Terms on the Site and updating the "Last Updated" date. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site or Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site or Platform (subject to the MSA regarding Platform service termination).

12. Termination of Access

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.


For Authorised Users, we reserve the right to suspend or terminate your individual access to the Platform if you breach these Terms (particularly the AUP in Section 5(b)), subject to any notification requirements agreed upon in the MSA with the Customer. Termination of the overall Platform service for a Customer is governed by the MSA.


All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Age Restriction

The Site and Platform are not intended for use by individuals under the age of 16. By using the Site or Platform, you represent and warrant that you are at least 16 years old.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.


You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales.

15. Miscellaneous

  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

  • Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

  • Entire Agreement: These Terms, together with the Privacy Policy, Cookie Policy, and (for Customers and Authorised Users) the applicable MSA and DPA, constitute the entire agreement between you and The Mind Distillery regarding your use of the Site and your individual conduct on the Platform, superseding any prior agreements.
